The first lawsuit against an Austrian ski resort of Ischgl, which became the hotspot of a COVID outbreak in March 2020, started in the court of Vienna on Friday.
The claim filed by 15 plaintiffs from Austria and Germany is aimed to hold the Austrian officials responsible for the alleged lack of due and timely response to the local outbreak at the ski resort.
The process on Friday was held on behalf of 72-year-old Hannes Schopf, who died after being infected with COVID-19 in Ischgl.
SOUNDBITES:
SOT, Peter Kolba, Lawyer (German):“I think it became clear, that there are many allegations, that partially were not called into question by the Financial Procurator’s Office. Of course, the priority lies in the legal question whether for example the epidemiological law only aims at the protection of the people, or whether it applies to the protection of individuals as well.”
SOT, Peter Kolba, Lawyer (German):“As said before, at the end of the day it depends on the Supreme Court if this claim is legally binding.”
SOT, Alexander Klauser, Lawyer (German): “The judge did not determine whether she considered my questions as admissible. In any case, the judge put herself in the position, that she is able to say whether the grounds for the claims, i.e whether the Republic of Austria is liable for these, without any further evidence procedure.”
SOT, Alexander Klauser, Lawyer (German): “If at the end of the day it should turn out, that my clients did submit rightfully for compensation, in other words, if the reason for this claim was to be confirmed, if there was no settlement made at that moment, this case would be elevated to the next level.”
SOT, Plaintiff and relative of COVID-19 victim (German): “I am a plaintiff myself. My life partner Mr Rudolf Lempik died after his ski holidays in Ischgl, hence all of this is quite close to me.“
