Jury deliberations in the Elizabeth Holmes fraud trial ended without a verdict on Wednesday, as the jury continued to weigh the charges on day sixth at the Robert F. Peckham US courthouse and federal building in San Jose.
“What you have seen thus far is that this jury has been up against the Christmas holiday, they are up against the New Years holiday. That didn’t get them to return a verdict. That suggests to me that they are very strongly set in their positions and there may not be movement from that point on. That certainly benefits Miss Holmes,” said former Santa Clara County District Attorney and Legal Analyst Steven Clark in front of the press.
“So there is nothing to read from that other than that there are certainly compelling arguments on both sides in this case. And when you have people fighting for both sides, that’s when deliberations will continue on,” he added.
The founder and former CEO of health technology company Theranos is accused of knowingly misleading investors, doctors and patients regarding the blood-testing capabilities of the health start-up.
Deliberations are scheduled to resume on Monday, January 3.

So there is nothing to read from that other than that there are certainly compelling arguments on both sides in this case. And when you have people fighting for both sides, that’s when deliberations will continue on. And at some point the judge may want to get a barometer and say ‘where are you jurors in this case because this has been going on now quite a long time’.”
