The Appeals Chamber of the International Tribunal for Lebanon began the first day of the appeal hearing in the case of the prosecutor against Hassan Habib Merhi and Hussein Hassan Oneissi on Monday in Leidschendam. The hearings are related to the 2005 assassination case of former Lebanese Prime Minister Rafik Hariri.

The period from 4th to 8th October has been set by the Appeals Chamber for hearing the appeal submitted by the public prosecutor against the ruling of the first instance issued on August 18th last year acquitting the defendants, Hassan Habib Marei and Hussein Hassan Oneissi of the charges against them in the assassination case.

In its judgment on 18th August 2020, the Trial Chamber found Mr. Salim Ayyash guilty of intentional homicide of Mr. Rafik Hariri with premeditation and attempted intentional homicide of 226 persons.

The Trial Chamber, however, acquitted Messrs, Oneissi and Sabra for lack of sufficient evidence proving, beyond a reasonable doubt, their complicity to the attack, and acquitted Mr. Merhi for insufficient factual evidence surrounding his actions.
