'No violation of law' in Afghan airstrike- Pentagon review, despite child seen minutes before strike

A Pentagon official said the US airstrike that killed 10 Afghan civilians in Kabul in late August did not violate any law according to an internal investigation, during a press conference in Arlington, on Wednesday.
“The investigation found no violation of law, including the law of war. It did find execution errors, combined with confirmation bias and communication breakdowns that regrettably led to civilian casualties,” said US Air Force Inspector General Sami Said.
“The intended target of the strike, the vehicle, the white corolla, its contents and occupant were genuinely assessed at the time to be a threat to US forces,” he added. “Regrettably, the interpretation of the correlation of the intelligence to what was being perceived at the time in real time was inaccurate.”
Despite Said saying the assessment was inacurate “given what was known at the time,” he acknowledged a child was visible on tapes from two minutes before the strike, but said personnel monitoring the live feed “did not pick up on the child” and only noticed them while reviewing the tape afterwards.
The airstrike, which killed three adults and seven children, came three days after a car bombing killed dozens of civilians and US military personnel at Kabul’s airport.
“You have to put yourself into the conditions that existed at the time. And what I mean by that is the risk to force at HKIA and the multiple threat streams that they were receiving of an imminent attack, attack. Mindful that three days prior, such an attack took place where we lost 13 soldiers, or lost 13 members, and a lot of Afghan civilians,” Said explained.
