Canada: 'We intend to seize and sell Iranian assets' - Lawyer of Iran plane crash victims' families

The lawyer of Ukraine International Airlines (UIA) Flight 752 crash victims’ families, Mark Arnold, expressed the intention to seize Iranian government assets during an interview held in Toronto on Tuesday.

The lawyer represents a group of five Canadian-based families of victims killed as a result of the shooting down of the UIA plane near Tehran by Iranian forces in January 2020.

A recent ruling by the Ontario Supreme Court of Justice, designated to the five families representing six deceased, has awarded the victims’ families a settlement of $107 million Canadian dollars ($84 million USD) in compensation.

“We intend to seize and sell Iranian assets that we know about in Canada and that we are discovering internationally,” said Arnold.

To claim the compensation issued by the court ruling, Arnold hopes to look into taking over Iranian capital in Canada and abroad, including “oil tankers, property, bank accounts, oil and gas drilling platforms and businesses.”

The lawyer also expressed hope in receiving help from the Canadian government in regards to direct negotiations with Iranian authorities.

All 176 people on board the flight, including 55 Canadian citizens and 30 permanent residents, died in the crash that occurred shortly after the take-off from Tehran’s Imam Khomeini International Airport.

SOT, Mark Arnold, Lawyer: “Well first of all, the award today that came out from the Ontario Superior Court of Justice is only designated to five surviving families representing six deceased. As we know, there were 175 people on this plan, each of whom had families. So this is only to the families that were part of this civil claim before the Ontario Superior Court of Justice. The award of $107 million [Canadian] dollars that includes a punishment component of a $100 million [Canadian] dollars is the largest of this type in Canadian judicial history. It has very, very significant impact on the families and quests for justice as a result of the shooting down by Iran of this plane.”

SOT, Mark Arnold, Lawyer: “The families who I act for are all in Canada. Four of them are in Ontario and one is in Quebec. Other families have requested to join the case, so there will be other families coming in shortly.”

SOT, Mark Arnold, Lawyer: “The Islamic Republic of Iran will pay.”

SOT, Mark Arnold, Lawyer: “How will it practicably be paid? We intend to seize and sell Iranian assets that we know about in Canada and that we are discovering internationally. So there are Iranian assets throughout the world and in Canada. That’s where we will get it from. The other thing is that we are hoping that the Canadian government will assist us in using the judgement we have from the court in their public attempts at negotiating a resolution directly with Iran.”

SOT, Mark Arnold, Lawyer: “I can confirm that we are looking to all Iranian assets internationally, including oil tankers, property, bank accounts, oil and gas drilling platforms and businesses and anything else that we can locate owned by the Islamic Republic of Iran.”

SOT, Mark Arnold, Lawyer: “I don’t care what the Iranian government thinks of the Canadian judicial system and the judgement that we have. We have an independent judiciary in Canada. We have a superior court judge who made a finding based on evidence that it was an intentional act of terrorism. In other words, the Iranian regime murdered 175 people on this aircraft, including 75 approximately Canadians. So really, I don’t care what the Iranian government thinks of the judgement.”

SOT, Mark Arnold, Lawyer: “This decision of course focuses on the facts of this case. We hope that there will never be another incident like this where an aircraft is shot out of the sky. But it will only pertain to this case and hopefully, it’s the last case of this type. But it’s unprecedented. It does not happen very often that a foreign government will shoot a commercial aircraft out of the sky. It happens very rarely. We had a Korean aircraft many years ago, was shot down, I believe, by the Russians. It’s happened. But they are rare incidents. When they happen, the governments pay. So for example the Lockerbie shootdown at the hand of the Libyans. The Libyan government eventually paid.”
