Russia’s Supreme Court postponed its hearing of the General Prosecutor’s Office’s claim to liquidate Russia’s oldest human rights group Memorial International, in Moscow on Thursday.

Memorial’s lawyer Maria Eismont commented that “It really is a meaningful trial” because “behind Memorial there are millions of souls of people murdered by the totalitarian regime.”

Eismont said that “Discussing how many protocols have been drawn up and whether the foreign agent label is correct is a disproportionate story altogether” adding that “Memorial is an organisation that must not be touched.”

RIA Novosti reports, citing a reporter who was present at the hearing, that “the Prosecutor General’s Office believes that the liquidation of the Memorial International is a proportionate measure to the violations it has committed”.

Memorial received a notification from the Supreme Court of the Russian Federation on November 11. According to the document, the Prosecutor General’s Office brought an action against the human rights group due to violations of Russia’s “foreign agent” rules.

The next hearing is scheduled for December 14.

SOT, Maria Eismont, Memorial International lawyer (Russian): “It really is a meaningful trial. You know, when it was announced that a lawsuit had been filed to liquidate Memorial, it [gave] the impression that this is the last line that still holds some humanity, it has been passed. Memorial is an organisation that must not be touched. Behind Memorial there are not just the wonderful people who work, the excellent lawyers who helped make the excellent position [of the defence], there are a lot of wonderful people. You see, behind Memorial, there are millions of souls of people murdered by the totalitarian regime. These people - not all their names have been spoken yet. Discussing how many protocols have been drawn up and whether the foreign agent label is correct is a disproportionate story altogether. That is not what the process is about. The trial is about the state, represented by the prosecutor’s office, accusing Memorial of violating the European Convention on Human Rights, the Universal Declaration of Human Rights, and the Universal Pact on Political Rights. You see, these are international covenants which states, not individuals or organisations, are obliged to follow.”

SOT, Henri Reznik, Memorial International lawyer (Russian): “The only thing I can say is, [that] this is our fate. The law is crap. Its application is disgusting. But in the Romano-Germanic system, unlike the Anglo-Saxon system, the courts have to apply the law regardless of its imperfection. So here we are, in court. And I hope in this process we will win.”
