An Israeli court ruled that a six-year-old survivor of an Italian cable car crash, Eitan Biran, must return to relatives in Italy on Monday in Tel Aviv amid a cross-border custody battle.
Eitan was the sole survivor of the cable car disaster in May, where his parents, sibling and grandparents were among the 14 people killed in the accident near Lake Maggiore.
Paternal relatives claim that Eitan was flown to Israel by his grandfather, Shmulik Peleg, without their consent.
“Today, the court decided to send back Eitan according to the Hay convention to Italy. We are very happy. We think that the real winner of this decision is Eitan. We think that Eitan must be back as soon as possible to his school, to his friends, to his grandparents, who are waiting for him in Italy,” said Shmuel Moran, a lawyer representing Aya Biran.
SOT, Shmuel Moran, Lawyer representing Aya Biran: “Today the court decided to send back Eitan according to the Hague convention to Italy. We are very happy. We think that the real winner of this decision is Eitan. We think that Eitan must be back as soon as possible to his school, to his friends, to his grandparents, who [are] waiting for him in Italy. We hope that we somehow will find a way to get a solution in Italy, of course, under the jurisdiction of the court in Italy, to find the best interest of the child there, that he will be with connections and relationships with all the family from both sides. And we are very happy for Eitan, and we hope that Eitan will be back as soon as possible.”
SOT, Avi Chimi, lawyer representing Aya Biran (Hebrew): “The court decision is the right and the moral one and we congratulate the court for taking it, saying that we want to make it clear that the pain of the grandparents in Israel is not greater then the pain of the family in Italy, they also love Eitan no less then the Peleg family.”
